Welcome to LA Spotlight. By purchasing advertising services, using our website, or participating in any postcard marketing campaign, you agree to the following Terms & Conditions.

 

1. Services Provided

LA Spotlight provides shared direct mail postcard advertising services to local businesses. Advertising may include placement in printed marketing mailers distributed to selected residential areas.

Advertising placement, postcard size, distribution areas, and campaign details may vary by mailing.

 

2. Advertising Placement & Category Exclusivity

LA Spotlight may offer category exclusivity on certain mailers, meaning only one business per business category may be featured.

Category exclusivity is determined solely by LA Spotlight and is granted on a first-paid, first-served basis. LA Spotlight reserves the right to define, modify, or interpret business categories at its discretion.

 

Exclusivity applies only to the specific campaign or mailing purchased and does not guarantee future exclusivity unless otherwise agreed in writing.

 

3. Payment Terms

Payment is required to reserve advertising placement unless otherwise agreed in writing.

 

Advertising space is not guaranteed until payment has been received.

Invoices are due upon receipt unless otherwise stated. Failure to make payment by the deadline may result in removal from the campaign without notice.

Late payments may forfeit reserved placement or exclusivity rights.

 

4. Artwork, Content & Approval

Advertisers are responsible for providing accurate business information, logos, offers, phone numbers, website details, and marketing content.

LA Spotlight may assist with design; however, the advertiser is responsible for reviewing and approving all final artwork before printing.

Once final approval is provided, LA Spotlight is not responsible for spelling errors, incorrect phone numbers, outdated offers, or other approved content mistakes.

 

Failure to submit required materials by deadlines may result in omission from the mailing without refund.

 

5. Printing & Distribution

LA Spotlight makes reasonable efforts to complete printing and mail distribution as scheduled; however, timelines may vary due to printing delays, mailing services, weather, holidays, vendor issues, or other circumstances beyond our control.

 

Distribution quantities and mailing areas are approximate and may vary.

LA Spotlight does not guarantee exact delivery dates.

 

6. No Guarantee of Results

LA Spotlight provides advertising and marketing exposure only.

We do not guarantee leads, phone calls, sales, revenue increases, customer conversions, or business results from any campaign.

 

Marketing performance depends on many factors including offer quality, pricing, market demand, seasonality, customer response, and advertiser follow-up.

Past performance does not guarantee future results.

 

7. Refund Policy

Due to upfront printing, design, and mailing costs, payments are generally non-refundable once artwork has been approved or production has begun.

Refund requests before production begins may be reviewed at LA Spotlight’s sole discretion.

 

If a campaign is canceled by LA Spotlight and not mailed, a refund or credit may be issued.

 

8. Right to Refuse Advertising

LA Spotlight reserves the right to reject or remove any advertisement at its discretion, including content that is misleading, inappropriate, unlawful, offensive, or inconsistent with company standards.

 

9. Limitation of Liability

LA Spotlight shall not be liable for indirect, incidental, special, or consequential damages arising from participation in any advertising campaign.

Maximum liability for any claim shall not exceed the amount paid by the advertiser for the specific campaign in question.

 

10. Indemnification

Advertisers agree to hold harmless and indemnify LA Spotlight from claims, damages, liabilities, or legal disputes arising from advertiser content, business practices, offers, trademarks, or representations.

 

11. Changes to Terms

LA Spotlight reserves the right to update these Terms & Conditions at any time without prior notice.
